Personal grievances

When a grievance claim arrives, you need to respond quickly and correctly.

Personal grievances can be raised for unjustified dismissal, unjustified disadvantage, discrimination, harassment, or failure to provide a safe workplace. Employees have 90 days to raise most grievances (12 months for sexual harassment claims), and once a claim is raised, the clock is ticking.

We help you assess the claim, understand your exposure, and decide on the best path forward. Sometimes that means defending your position through mediation or the Employment Relations Authority. Sometimes it means negotiating a pragmatic settlement. We’ll give you honest advice about your options and support you through whichever path you choose.

What we do:

·       Initial assessment and risk analysis

·       Response preparation and strategy

·       Representation at mediation

·       Negotiating settlements and exit agreements

·       Preparing for Employment Relations Authority proceedings (if needed)

·       Post-grievance process improvements
